Terms & Conditions
The terms that apply when you use the IRID Gallery website, make an enquiry or purchase a photographic artwork through the gallery.
These terms apply to www.iridgallery.com.au and to purchases made online or directly through IRID Gallery. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded.
About the artworks
IRID represents contemporary photographers and offers fine art photographic works, including signed and numbered limited-edition prints. Edition size, dimensions, materials, presentation and artist-proof information are stated on the artwork page, certificate or written quotation.
Because screens, paper, ink, framing and viewing conditions vary, slight differences in colour, tone, scale and appearance between a digital preview and the finished artwork are normal and are not necessarily a defect.
Availability and editions
Availability is subject to the remaining edition and successful payment. Adding an artwork to a cart or requesting information does not reserve an edition unless IRID confirms otherwise in writing.
Edition numbers may be allocated at fulfilment and may not be supplied sequentially. Artist proofs and other authorised variants are identified separately where applicable.
Pricing and payment
Prices are shown in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. Prices may change without notice, but a confirmed order is charged at the agreed price.
Payment is required in full unless IRID agrees to another arrangement in writing. An order is accepted when IRID issues confirmation and payment has cleared.
Ownership of the physical artwork passes to you after cleared payment in full. Copyright and other intellectual property rights do not transfer with ownership of the print.
Production
Most prints and framed works are made to order. Production time varies according to the artwork, size, material, framing and supplier availability. The estimated timeframe will be shown on the artwork page, at checkout or confirmed by the gallery in writing.
Timeframes are estimates rather than guaranteed delivery dates. IRID will contact you if a material delay or production issue arises.
Shipping and delivery
Shipping costs and delivery methods depend on artwork size, presentation and destination. Charges are shown at checkout or confirmed in writing for larger, framed or international orders.
You are responsible for providing a complete and accurate delivery address and for ensuring someone can safely receive the artwork. Risk passes to you when the artwork is delivered to the nominated address or accepted by your authorised recipient.
International recipients are responsible for customs duties, import taxes, brokerage fees and local charges unless IRID expressly agrees otherwise in writing.
Cancellations and change of mind
Because limited-edition prints and framed works are generally produced to order, IRID does not ordinarily accept returns or cancellations for change of mind. Contact the gallery promptly if you need to request a cancellation. Where production has not started, IRID may agree to a cancellation at its discretion.
This change-of-mind position does not limit any rights you have under the Australian Consumer Law.
Damage, faults and incorrect orders
Inspect the package and artwork promptly after delivery. If the artwork arrives damaged, faulty or materially different from its description, contact hello@iridgallery.com as soon as practical, preferably within seven days, and include the order details, packaging photographs and clear images of the issue.
Depending on the circumstances and your rights under the Australian Consumer Law, the remedy may include repair, replacement, re-supply or refund. The seven-day notification request does not remove or shorten any non-excludable legal right.
Keep all original packaging until the gallery confirms whether it is required for assessment, return transport or an insurance claim.
Certificates and authenticity
Eligible limited-edition works are supplied with a certificate of authenticity or other edition documentation confirming details such as the artist, title, edition number, edition size, materials and authorising signature.
Store the certificate separately and securely. Replacement documentation may not always be possible and may require verification by IRID, the artist or an authorised representative.
Intellectual property
Website content, photographs, text, graphics and branding are owned by IRID, the represented artists or relevant licensors and are protected by copyright and other laws.
Purchasing an artwork gives you ownership of the physical object. Copyright, reproduction rights and commercial-use rights remain with the artist or copyright owner. You may privately display or lawfully resell the physical artwork, but you must not copy, reproduce, publish, license, create merchandise from or commercially exploit the image without written permission.
When reselling an edition, keeping the certificate and provenance documentation with the artwork helps preserve its history and authenticity.
Website use
You must not misuse the website, interfere with its security or operation, attempt unauthorised access, scrape content at scale, or use the site or its images in a way that infringes intellectual property or other rights.
The website may contain links to third-party services. IRID is not responsible for the availability, content, terms or privacy practices of those external services.
Liability
Nothing in these terms excludes or limits any guarantee, right or remedy that cannot be excluded under the Australian Consumer Law or other applicable law.
To the extent permitted by law, IRID is not liable for indirect, incidental or consequential loss arising from use of the website or an artwork purchase. Where liability can lawfully be limited, IRID’s liability will be limited to the remedy permitted by law, which may include replacement, repair, re-supply or refund.
Governing law
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals with jurisdiction in Victoria, subject to any mandatory rights that apply in another jurisdiction.
Changes to these terms
IRID may update these terms from time to time. The terms applying to an accepted order are those provided or published when that order was confirmed, unless a change is required by law.
